Recount the same - Scarth the winner
The same result occurred in a formal recount of the hotly-contested and court-challenged Kane County Attorney’s race between appointed and current Kane County Attorney Jim Scarth and challenger, former Kane County Deputy Attorney William Bernard.
Scarth won on election night, June 22, by 17 votes, 694-677. Then, after provisional paper ballots were counted on June 29, he won by eight votes, 709-701. Bullfrog and Cedar Mountain are given paper ballots by mail, at the choice of the commission.
Once all those votes were counted, the normal county voting canvass occurred, and verified those election results as accurate.
Bernard filed in Sixth District Court on July 9 against Jim Scarth, as respondent, demanding a verified petition for a recount and contesting primary results and seeking canvassing.
The county did the recount as a courtesy. The exact same number of votes between Scarth and Bernard resulted after the lengthy process of recount was accomplished by 12 people working at four verification stations. (All are poll workers.) The process was witnessed by Kane County Republican Chair Lloyd Laycook, along with numerous public attendees.
Jim Scarth again won the Kane County Attorney’s race by eight votes. No court date has been set for on Bernard’s formal court request.
